OFFICIAL RULES
IF YOU DO NOT RESIDE IN THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA YOU ARE NOT ELIGIBLE TO PARTICIPATE IN THIS CONTEST.
1. NO PURCHASE NECESSARY TO ENTER OR WIN.
2. INTRODUCTION
These rules apply to the online contest sponsored by OPEN Sports
Network Inc. ("Sponsor") and known as "OPEN Office Pool Challenge"
("Contest"). The Contest runs during the National Football League
("NFL") regular season for games beginning on Thursday, September 4,
2008 and continuing each week through Sunday, December 28, 2008. The
Contest tests one's skill in trying to pick the winner of every NFL
game.
3. REGISTRATION
You must be a registered OPEN Sports.com user to participate in the
Contest ("User"). There is no cost to become a User. To enter, go to
http://www.opensports.com/games/football/nfl/office_poll_challenge
("Website") and click on "Open Office Pool Challenge" and follow the
instructions. There is no cost to enter or participate in the Contest.
4. ELIGIBILITY
To participate in the Contest, you must be a User who is of legal
age in the jurisdiction where you reside at time of entry and a legal
resident of one of the 50 United States or the District of Columbia.
Void where prohibited by law. Employees of the Sponsor and its
affiliates, parent company, subsidiaries, and advertising and promotion
agencies, endorsers, consultants, and any contractors working on the
Contest and the immediate family members or those living in the same
household of each, are not eligible. Immediate family members include
parents, siblings and children.
5. GAMEPLAY
Each week, the Website will list the scheduled NFL games. You must
pick the team that will win each game, along with total points scored
by both teams in each of the designated tie-breaker games. The results
of tie-breaker predictions are important in the event of a tie for
weekly winner. Only one winning team may be selected for each game. You
must pick for every game in each of the weeks you participate. Limit
one entry per person. You may change your selections for a game at any
time up to 5 minutes prior to a game's scheduled kickoff. If you submit
more than one entry, the last valid entry received will be used and the
other entries will be disqualified. Any entry that is incomplete, late,
or does not include a validly issued user name and password will be
disqualified.
The Contest will use the Monday and Sunday night games as
tiebreakers and you must enter the home and away score for each one.
The tiebreakers will work in this order:
- Monday Night Game Total as 1st tiebreaker
- Monday Night Home Team Total as 2nd tiebreaker
- Monday Night Away Team Total as 3rd tiebreaker
- Sunday Night Game Total as 4th tiebreaker
- Sunday Night Home Time Total as 5th tiebreaker
- Sunday Night Away Team Total as 6th tiebreaker
In the unlikely event of a tie, Sponsor will conduct a drawing from
among those who are tied that week. Odds of becoming a weekly winner
depend upon the number of eligible entries received, your knowledge of
professional football, the knowledge of other contestants of
professional football, and the results of various professional football
games.
Each week during the NFL season, you will be awarded
one (1) point for each game for which you correctly selected the
winner. No points will be awarded for an incorrect selection or if the
game results in a tie, is postponed or cancelled. For any week in which
you do not submit an entry, you will receive zero points. Weekly scores
are determined by adding one point for each correctly picked game for
that week. The eligible entrant with the most points each week will be
deemed that week’s winner and will receive a cash prize of $1,000 Each
weekly potential winner will be notified by email by the Wednesday
following each Monday night game and will be sent an Affidavit of
Eligibility and Liability/Publicity Release. To claim a prize, a
potential winner must return a completed and signed Affidavit of
Eligibility and a signed Liability/Publicity Release on Sponsor's forms
within ten (10) business days. If a potential weekly winner cannot be
contacted by the Wednesday following the Monday night game for that
week or fails to return the required forms to Sponsor within ten (10)
days, the potential winner forfeits the weekly prize.
If, for any reason, the Contest is not capable of
running as planned, including infection by computer virus, bugs,
tampering, unauthorized intervention, fraud, technical failures or any
other causes beyond the control of the Sponsor which corrupts or
affects the administration, security, fairness, integrity or proper
conduct of the Contest, Sponsor reserves the right, at its sole
discretion, to disqualify any individual who tampers with the entry
process and cancel, terminate, modify or suspend the Contest. Sponsor
assumes no responsibility for any error, omissions, interruption,
deletion, defect or delay in operation with transmission,
communications, line failure, theft or destruction or unauthorized
access to or allegation of entries. Sponsor is not responsible for any
problem or technical malfunction of any telephone network or lines,
computer online systems, servers, equipment or software, failure of any
email or entry to be received or received timely on account of
technical problems or traffic congestion on the Internet or at any web
site, phone lines, or any combination thereof, including any injury or
damage to a participant's computer related to or resulting from
participation in this Contest. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO
DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION
OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD
SUCH AN ATTEMPT BE MADE, OPENSPORTS.COM RESERVES THE RIGHT TO SEEK
DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
If Sponsor discovers any participant conducting
unlicensed, illegal or professional gambling in connection with the
Contest, Sponsor may disconnect such participant at once without
warning and without any liability. The Contest and the Website are not
sponsored or endorsed by the National Football League.
As a participant, you have a limited license to
access and use the software that comprises the pools for which they
have registered. You may not reproduce, copy, or redistribute, in whole
or in part, any of the software that constitutes the service functions
relating to the operation of the Contest and shall not acquire any
rights of any kind in any of the Sponsor's software, programs or other
property.
Sponsor reserves the right to immediately modify,
suspend or terminate your participation in the Contest and as a User,
if the Sponsor, in its sole and exclusive discretion, believes that you
have acted inconsistently with these Official Rules.
By participating in the Contest, you agree to be
bound by the terms of the Official Rules and by the decisions of the
Sponsor, which are final and binding on all matters pertaining to the
Contest. This Contest and service are governed by the laws of the State
of Florida without regard to its conflict of laws rules. All federal,
state, and local laws and regulations apply. All taxes on prizes are
the sole responsibility of the prizewinner. By entering, you release
and hold harmless Sponsor, its parent, subsidiaries, affiliates,
directors, officers, employees, and agents from any and all liability
or any injuries, loss, or damage of any kind arising from or in
connection with conduct of the Contest or any prize won. You may
request in writing that your name and address not be used for any other
purposes. All entries become the property of Sponsor and will not be
returned. Sponsor is not responsible for human or technical errors in
the offer or administration of this Contest, including but not limited
to errors in advertising, the Official Rules, the selection and
announcement of the winners or the distribution of the prizes. Sponsor,
in its sole discretion, may disqualify you from participating in the
Contest, refuse to award points or prizes, and require the return of
any prizes, if you engage in any conduct Sponsor deems to be improper,
unfair or otherwise adverse to the operation of the Contest or
detrimental to other entrants. Such improper conduct includes, but is
not limited to, falsifying personal information required to register
for a user name and password or to claim a prize violating any term or
condition of the Official Rules, accumulating points or prizes through
methods such as automated computer scripts or other programming
techniques, allowing others to use the your personal information for
the purpose of accumulating points or prizes, tampering with the
administration of the Contest, or intentionally trying to defraud,
reverse engineer, disassemble, decompile or otherwise tamper with the
computer programs on the website. You further acknowledge that the
forfeiture of prize(s) and/or return of any prize(s) shall in no way
prevent Sponsor from pursuing criminal or civil proceedings in
connection with such conduct.
By entering the Contest, you agree to abide by the
terms of the Official Rules and by the decisions of Sponsor, which are
final on all matters pertaining to the Contest. Sponsor is solely
responsible for enforcing the Official Rules and maintaining the
integrity of the Contest.
For a list of the weekly prize winners, send a
self-addressed stamped envelope between January 15, 2009 and February
28, 2009 to: OPEN Sports Network, Inc., attention: Office Pool

Beach, Florida 33442. Residents of Vermont may omit return postage.
