OPEN SPORTS "TACKLE THE PROS" FANTASY FOOTBALL CHALLENGE OFFICIAL RULES
HOW TO REGISTER

No purchase necessary to play. Playing the "Tackle the Pros" Fantasy Football contest ("the Game") is free. Participants may register for the Game at any time during the course of the 2008 NFL regular season, beginning on September 4, 2008. The signup process requires the user to be a registered user on Opensports.com (the "Website"). Users log in to the Website using their username and password.

To register, go to http://www.opensports.com/games/football/nfl/tackle_the_pros. Any registration that fails to provide all required information will be disqualified.

By playing the game, participants agree to these Official Rules and the Websites' Service Agreements and Terms of Use and Privacy Policies and to the decisions of Sponsor and Administrator, which shall be final with regard to all matters relating to the Game.

 
 
GAMBLING PROHIBITION

THIS GAME HAS BEEN DEVISED AS A SKILL-BASED, NON-GAMBLING PROMOTION. Winners are determined by contestants who use their skill and their knowledge of relevant professional sports information to accumulate the highest point totals during the Game in accordance with the official rules. Use of the Game in connection with any form of gambling is strictly prohibited. The Game is not affiliated with, nor sponsored or endorsed by the National Football League.

 
 
To Enter

To enter, complete the registration form at the Website. Entrants will be asked to create a user ID and password, which they must use for future logins to their team page.

 
 
ELIGIBILITY

You must be the age of majority in your state of residence, and a legal resident of the fifty United States or the District of Columbia at the time you register. Residents under the age of majority may play, but only with the written permission of their parent or legal guardian. The Game is subject to all federal, state, and local laws, and is void in Puerto Rico, all U.S. territories and possessions and wherever prohibited by law. Directors, officers, and employees of Sponsor and Administrator, their divisions, subsidiaries, affiliates, endorsers, consultants, participating pros, advertising, promotion and fulfillment agencies, and any others involved in the creation, production or execution of the Game and members of their immediate families, (parents, siblings and children of their spouses) or any person residing in their households (whether or not related) are not eligible to win.

 
 
HOW TO PLAY / DETERMINATION OF WINNERS

Collusion between any two participants, as determined in the Sponsor's sole discretion, is strictly forbidden, and grounds for action disqualification.

 
 
Roster

The contestant's roster must consist of 8 players:
1 Quarterback
2 Running Backs
2 Wide Receivers
1 Tight End
1 Kicker
1 Team Defense/Special Teams

A roster must be valid (8 players selected) before a contestant is eligible to compete. Contestants must choose only from players listed online. Players are only eligible at the position listed and player positions will not change during the Contest Period.

Each contestant begins with a $100 budget. The contestant's original 8-man roster must not exceed the $100 salary cap. After week #1 of the football season, the salaries for each player can adjust weekly depending on a player's performance or injury status (i.e. if a player is injured or he is performing below standard, his salary could drop).

 
 
Contest Deadlines

During the week a roster may be changed up to 5 minutes before the scheduled start of a player's game. Once a week's roster becomes final (after the start of the Monday night football game) a roster must be full (active) in order to score points for the week. Rosters with empty positions after the start of the Monday night football game will be labeled as inactive and will score zero (0) points for the week.

Once an NFL player plays a game during the week, the roster position may not be changed during the remainder of that week.

The contest begins with the first game on Thursday, September 4, 2008 and ends after the last game, estimated to be December 28, 2008 (the "Contest Period"). Any games played before September 4, 2008 or after December 28, 2008 do NOT count towards your weekly or season-to-date totals. The Contest consists of 17 Contest weekly periods ("Contest Week 1," "Contest Week 2," etc., collectively "Contest Weeks").

Trading Players

The trading deadline is always 5 minutes prior to kickoff of that player's scheduled game. Once this deadline passes, the player and respective roster position is locked until the end of the week (Tuesday morning). All player trades must be made online at the Website.
A player must be traded for another player at the same position. The contestant must remain at or under the salary cap after all trades are made.

 
 
Scoring
Scoring is awarded based on the scoring system below:

Offensive Scoring:
  •          A. Touchdowns (Passing, Rushing, Receiving) : 6 points
  •          B. Two-Point Conversion (Passing, Rushing, Receiving): 2 points
  •          C. Field Goals (Kickers Only): 3 Points
    •                   Add 2 points for 40-49 yards
    •                   Add 3 points for 50-59 yards
    •                   Add 5 points for 60+yards
  •          D. Extra Points (Kickers Only): 1 point
  •          E. Passing Yards: 1 point for every 25 yards
    •                   300 yards or more: 3 point bonus
    •                   Interceptions: - 2 points
  •          F. Rushing Yards: 1 point for every 10 yards
    •                   100-149 yards: 2 point bonus
    •                   150-199 yards: 2 point bonus
    •                   200 yards or more: 2 point bonus (if RB has 220 yards would get bonus each tier)
  •          G. Receiving Yards: 1 point for every 10 yards
    •                   1 point per reception
    •                   100-199 receiving yards: 2 point bonus
    •                   200 + yards: 3 point bonus
  •          H. Fumbles: - 2 points
Defensive Scoring:
  •          I. Defense or Special Team Touchdowns: 6 Points
  •          J. Defense or Special Teams Fumble Recovery: 2 points
  •          K. Interceptions: 2 points
  •          L. Sack: 1 point
  •          M. Safety: 4 points
  •          N. 2 points blocked punt or blocked field goal
  •          O. Points Scored Breakdown:
    •                   0-1 points allowed: 12 points
    •                    2-6 points allowed: 10 points
    •                    7-13 points allowed: 8 points
    •                   14-20 points allowed: 6 points
    •                   21-27 points allowed: 4 points
    •                   28-30 points allowed: 2 points
  •          P. Yards Allowed Breakdown:
    •                   0-125 yards allowed: 10 points
    •                   126-175 yards allowed: 8 points
    •                   176-225 yards allowed: 6 points
    •                   226-275 yards allowed: 4 points
    •                   276-300 yards allowed: 2 points
Players DO receive credit for kick/punt return TD's, but NOT for kick/punt return yardage. Scoring is calculated based on TOTAL (NOT average) number of points each player earns in a week. If, for any reason, a player's game is postponed (due to weather, etc.) you will only receive points for that game if you have the player on your roster the day the game is officially completed.

Each week, all registered contestants compete head to head against that week's designated professional athlete ("Pro"). If a contestant's weekly score is greater than the weekly score of that week's Pro, he or she wins that week's match up. Every registered user that wins his/her weekly Pro match up is entered into a sweepstakes drawing for a chance to win autographed memorabilia from that week's designated athlete.
The Pro's roster each week will abide by the same salary cap and deadline rules as posted for all registered users.
 
 
GENERAL CONDITIONS

By participating, contestants agree to be bound by the decisions of the Sponsor and Game Administrator, which shall be final and binding. Sponsor is not responsible for and shall not be liable for lost, misdirected, late, delayed, incomplete, unreadable, garbled, damaged or inaccurate entries or Game information provided by participants.


In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed to be submitted by the authorized account holder of the domain name from which the entry was made. "Authorized account holder" is the natural person who is assigned a domain name by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents will void all entries by that participant.


Sponsor and Administrator assume no responsibility for any computer, software, online, telephone or technical malfunctions that may occur, for any incorrect or inaccurate information, whether caused by Website users, equipment or programming associated with or utilized in the Game, or any technical, human or other error which may occur in the processing of submissions or administration of the Game, for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries, for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers on account of technical problems or traffic congestion on the Internet, or at any website, or on account of any combination of the foregoing. Sponsor and Administrator are not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Game, for theft, destruction, unauthorized access to, or alteration of entries; problems submitting entries from the Websites; or for any errors or other problems related to Website entries or Game administration.


If, for any reason, the Game is not capable or running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which impair, corrupt or otherwise adversely affect the administration, security, fairness, integrity or proper conduct of this Game, Sponsor and Administrator reserve the right at its sole discretion to cancel, terminate, modify or suspend the Game in whole or in part and award proper prizes to the participants with the highest rankings at the time of the impairment. Notice of any cancellation, termination or modification will be posted on the Websites.


Sponsor or Administrator may, in their sole discretion, prohibit any contestant from using the Website or participating in the Game, and refuse to award points or prizes if a contestant engages in any conduct Sponsor deems to be improper, unfair, detrimental, unsportsmanlike, or otherwise adverse to the operation of the Websites, Game or other contestant. Such conduct includes, but is not limited to falsifying personal information required during registration, entry, or prize claim, supplying any information designed to circumvent any provision of these Official Rules, violating any term or condition stated herein, accumulating points or prizes through methods such as automated computer scripts or any other programming techniques, allowing others to use participant's personal information for the purpose of accumulating points or prizes, or trying to defraud, reverse engineer, disassemble or otherwise tamper with the computer programs on the Websites. Participants agree to return any prize that they have won as a result of such conduct.


CAUTION: ANY ATTEMPT BY AN PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION OF SUCH PARTICIPANT. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS' FEES) AND OTHER LEGAL RECOURSE, INCLUDING CRIMINAL PROSECUTION, FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION.


Any promotion materials, including the offer or these Official Rules, which contain production, printing or typographical errors, or are obtained outside authorized or legitimate channels are void; and Sponsor's and Administrator's liability, if any, is limited to the replacement of such materials. Recipients waive all rights to claim any and all losses, claims or damages that may result therefrom. Sweepstakes materials are automatically void if they are reproduced, mutilated, forged, altered or tampered with in any way, or if they are obtained outside authorized, legitimate channels.


By participating, entrants agree to release and hold Sponsor, Administrator, their parents, subsidiaries and other affiliated companies, advertising and promotion agencies and their respective directors, agents and employees harmless from all liability, loss, personal injury or death, or damage to reputation or of any kind attributable in whole or in part, directly or indirectly, to their participation in the Game or their acceptance, possession and/or use of a prize or travel to or from or participation in any prize-related activity.

 
 
PRIZES

Approximate Retail Value of each Weekly Autographed Prize (17 total), is $150.00, Total combined ARV of all Weekly prizes: $2,550.

The Overall Season Points winner will win their choice of one autographed item from each of three participating pros. ARV: $449. There will be one Overall Season Points winner. The eligible, registered contestant with the most points for the entire Contest Period will be the Overall Season Points winner. In the event of a tie, the Overall Season Points winner will be the contestant involved in the tie with the highest weekly score for Contest Week 17. If a tie still exists, the Overall Season Points winner will be the contestant still involved in the tie who has the highest weekly score for Contest Week 16. If a tie still exists, this tie breaking process will continue by comparing the next prior Contest Week (from Contest Week 15 and so on until Contest Week 1, if necessary) results until a winner is determined.


Each registered participant will be eligible for a chance to win the Grand Prize. The Grand Prize winner will win a Super Sports Experience. ARV is $2,000. Actual value will depend on time of travel, fluctuations in airfare and residence of winner. Super sports experience includes roundtrip coach class airfare from major airport nearest winner's residence to Ft. Lauderdale, Florida, 2 night(s) stay at a hotel designated by Administrator, a meet and greet with a participating Pro designated by Administrator, which is subject to Pro's availability. Travel arrangements must be made through Sponsor's travel agent or on a carrier of Sponsor's choice. Advance reservations required. Trip must be completed by July, 2009. Unless specified above, prize does not include insurance, telephone charges, personal expenses, travel arrangements between winner's home and airport of departure, ground transportation, parking, gratuities, food, merchandise, souvenirs, beverage or other incidental charges and all expenses related to acceptance and use of prize, all of which are the prize winner's responsibility. Travel is subject to terms, restrictions, availability, blackout dates, and/or change due to circumstances beyond Sponsors' control. No extensions will be permitted, and any unused travel or component thereof will be forfeited. Prize cannot be used in conjunction with any other promotion or offer and may not be separated. Tickets issued or accommodations awarded in conjunction with the prize are not eligible for frequent flyer, frequent guest or similar awards programs.


Grand Prize winner will be selected via a random drawing on or about January 5, 2009. Sponsor will attempt to notify potential winner by e-mail, and/or telephone within approximately two weeks after drawing. If a potential winner cannot be reached after a reasonable effort has been made during ten (10) business days from the first notification attempt, such person may be disqualified and no alternate winner will be selected. To claim a prize, a potential winner must return a completed and signed Affidavit of Eligibility and a signed Liability/Publicity Release on Sponsor's forms within twenty (20) business days. If a potential weekly winner cannot be contacted by the Wednesday following the Monday night game for that week or fails to return the required forms to Sponsor within twenty (20) days, the potential winner forfeits the weekly prize.


Sponsor and its agents make no warranties, representations or guarantees relative to any prize, and disclaim all liability for the provision, quality or nature of any third party product or services provided to winner or travel companion. All federal, state or other tax liabilities arising from this Game, if any, will be the sole responsibility of the winner. Winners may receive an IRS 1099 form reporting the value of their prize. Prizes are nontransferable and non-refundable and must be accepted as awarded. No substitution may be made, except by Sponsor or Administrator, who reserve the right, in their sole discretion, to substitute a prize with another prize of greater or equal value in the event that a prize or portion of prize is unavailable. Except where prohibited, winners may be required to sign and return to Sponsor an Affidavit of Eligibility and a Liability and (where not prohibited) a Publicity Release. Except where prohibited, participation in the Game constitutes winner's consent to Sponsor's and it's respective designees' use of winner's name, likeness, voice, opinions, biographical information and state of residence for promotional purposes in any media without further payment, consideration, credit, or right of approval or review (where not prohibited by law), and any such use with respect to minors will be subject to prior written approval from the parent or legal guardian. If a winner is a minor under applicable state law, prize will be awarded in the name of his/her parent or legal guardian, and all releases and affidavits must be signed by his/her parent or legal guardian.

 
 
DISPUTE RESOLUTION

ARBITRATION/CHOICE OF LAW. Except where prohibited, participants agree that any and all disputes, claims and causes of action arising out of or connected with this Game shall be resolved exclusively by arbitration pursuant to the Rules of the American Arbitration Association then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by participant with regard to this Game, but in no event attorneys' fees, punitive, incidental, consequential or other damages. All issues and question concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor and/or Sponsor's agencies in connection with the Game shall be governed by and construed in accordance with the laws of Florida, without regard for conflict of law or choice of law rules which would cause the application of the laws of any jurisdiction other than Florida.

A list of prize winners may be obtained by sending a hand-printed, self-addressed stamped envelope between January 5, 2009 and February 28, 2008 to: OPEN Sports Network, Inc., attention: Winners' List, 2200 SW 10th Street, Suite 200, Deerfield Beach, Florida 33442. Residents of Vermont may omit return postage.
